What is a Notary Public?

A Notary, or Notary Public, can authenticate or arrange the legalisation of any document. You will normally require the services of a Notary Public when you have documents which are needed to be used abroad. The Notaries signature and seal will verify to the authorities in that country that the relevant checks have been carried out. Our Notary Public can also advise in relation to legalisation or the application of an apostille, if needed.

The need for a notary public is dictated by the requirements of the country where the document is to be used. For example, if you wish to buy a property abroad, it is often necessary to give your overseas lawyer power to deal with the purchase. This can be done by means of a power of attorney, which is signed by you in front of a notary. The notary public will confirm your name and identity and sign the document and seal it with their official seal.

James Jones Notary Public can draw, attest or certify under his official seal, for use anywhere in the world, deeds and other documents including Wills, Conveyances of real and personal property and Powers of Attorney. A Notary’s signature and seal will verify to the authorities in a foreign country that any relevant checks have been carried out and that the document has been properly signed.

Legislation

In addition to sealing by the Notary Public, many documents need to be legalised. This is the procedure by which the state authority of one country satisfies the state authority of another country that the signature of a public officer such as a Notary Public is genuinely his or hers. In many cases, the addition to the document in question of an Apostille sealed by the Department of Foreign Affairs is sufficient. However, depending on the country of destination a document may also need to be presented at the Supreme Court and also at the embassy of the destination country.

Consular Services

James Jones Notary Public believes that his clients deserve an excellent service and accordingly is available at short notice and can come to you or meet you on the move. Our Notary Public office is centrally located near the Department of Foreign Affairs at 3 Lower Mount Street, Dublin 2.

In addition we are happy to arrange for documents to be brought to the department of foreign affairs, Supreme Court or to any embassy during the course of legislation. Our office on Lower Mount Street, near the corner of Merrion Square, Dublin 2 is very close to a DHL depot and we regularly arrange for documents to be couriered across the World after they have been Notarised.

The following are some of the Notary Services we provide:

  • Attesting the signatures of directors and other company officers to company documents for use abroad
  • Attesting certificates of existence for people receiving overseas pensions
  • Preparing declarations of freedom to marry for persons wishing to be married abroad
  • Assignments or registration of trade marks
  • Shares issues certified by a notary public
  • Copies of passports for example to open a bank account.
  • Permission to let one parent or childminder travel abroad with children
  • Attesting of Adoption Pack, Adoption Dossier for Inter-Country Adoption as required by the foreign country where the clients wish to adopt.
  • Any other documents for abroad which require a notary public stamp

Identity of appearer

Our Notary Public before is obliged to obtain identification from the person who wishes to transact notarial business and will require you to bring at least two of the following three forms of identity:-

1. Passport
2. Driving Licence
3. Utility bill

The Notary may make, and retain on file for five years, a copy of any identification document produced to the Notary. Driving licences are not generally accepted by Notaries if the transaction has a foreign element i.e. is concerned with the movement or acquisition of assets or property outside the State.
